SMS Terms & Conditions

1. Purpose, Scope, and Incorporation

These SMS Terms & Conditions (“SMS Terms”) explains how Watch Systems LLC (“Company,” “we,” “us,” or “our”) uses text messages in connection with OffenderWatch^® Remote Express (“Remote Express”) and other Company Applications. It applies to every User who accesses or uses Remote Express, no matter where the User lives. These SMS Terms are part of the Watch Systems LLC Registrant Terms of Use (“Registrant Terms of Use”). The Registrant Terms of Use, these SMS Terms, the Biometric Policy, and the Privacy Policy (together, the “Agreement”) govern the User’s access to and use of Company Applications. If these SMS Terms conflict with the Agreement, these SMS Terms control with respect to our transmission of text messages only.

2. Definitions

• “Agreement” means the Watch Systems LLC Registrant Terms of Use and the policies that are part of those Terms of Use, including this Policy, the Privacy Policy, and SMS Terms and Conditions.
• “Biometric Policy” means Company’s biometric policy for collecting and using biometric data, which is part of the Agreement, which can be accessed at https://www.offenderwatch.com/biometric-info-policy‍
• “Company Applications” means the applications that User can access through or that Company makes available through its website at www.offenderwatch.com, including Remote Express.
• “Privacy Policy” means Company’s privacy policy for collecting and using personal data, which is part of the Agreement, which can be accessed at https://www.offenderwatch.com/privacy-policy“User” means you, the individual who accesses or uses Remote Express. “You” and “your” refer to the User.
• “User” means you, the individual who accesses or uses Remote Express. “You” and “your” refer to the User.

3. Program Description

The Remote Express SMS program sends compliance-related text messages to Users who have opted in. Messages are limited to:

This is a service and compliance-notification program. It is not a marketing program, and we do not send promotional or advertising messages through it.

4. How You Enroll and Consent

Your mobile phone number is collected during the registration-intake process administered by your supervising agency. By providing your mobile number and opting in, you consent to receive recurring automated text messages from Remote Express at that number for the purposes described in Section 3 above. A record of your consent — timestamped and versioned — is stored in the Remote Express platform. Consent to receive text messages is not a condition of registering or of any government service; you may register and comply through your supervising agency’s other available methods without enrolling in SMS.

5. Message Frequency

Message frequency varies and is recurring. The number of messages you receive depends on your registration deadlines, appointment schedule, and account activity.

6. Message and Data Rates

Message and data rates may apply. Charges are determined by your wireless carrier and are your responsibility. Company does not charge a separate fee for text messages.

7. Opting-Out and Getting Help

You may opt out of receiving text messages from Company at any time by replying STOP to any message from us. After opting out, you may receive one final message confirming your unsubscribe request. No further text messages will be sent unless you re-enroll in the program. For help, reply HELP or contact us at support@offenderwatch.com.

Opting out of SMS does not change your legal registration obligations, and it does not affect your supervising agency’s own means of contacting you. You remain responsible for meeting your registration requirements and deadlines regardless of whether you receive text messages.

8. Privacy and Data Processing

Information collected in connection with our text messaging program will be handled in accordance with our Privacy Policy, which can be accessed at https://www.offenderwatch.com/privacy-policy.

9. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

10. Updates to these SMS Terms

Company may update these SMS Terms from time to time. For a material update, Company will revise the effective date and version number for these SMS Terms and use reasonable means to tell Users before the changes take effect. Your continued enrollment after an update constitutes acceptance of the revised SMS Terms.
